تامین دلیل
تاخیر یا عدم انجام وظایف و تعهدات قانونی و قرادادی یا سهل انگاری و بی مبالاتی برخی از اشخاص و بسیاری از دلایل دیگر ممکن است باعث ورود ضرر و خسارت به دیگران شود و شخص متضرر ممکن است به دلایل گوناگون از قبیل فراهم نبودن مقدمات طرح دعوا یا وجود برخی از موانع امکان طرح دعوا در زمان وقوع حادثه با تخلف را نداشته باشد بخواهد طرح دعوا را به آینده موکول نماید. ولی احتمال دارد كه در آينده استفاده از دلايل و مدارك دعوا از قبيل تحقيق محلي و كسب اطلاع از مطلعين يا دفاتر تجاري يا استفاده از قرائن و امارات موجود در محل و يا دلايلي كه نزد طرف دعوا يا ديگري است، ممکن نباشد.
گاهی نیز ممکن است رسیدگی و صدور رای و سپس قطعی شدن رای و اجرای آن به درازا کشیده شود و شخص متضرر برای جلوگیری از ضرر بیشتر شخصا ناچار باشد اقداماتی را برای اعاده وضع سابق انجام دهد و بعدا تشخیص و تخمین خسارت ممکن نباشد.
از این رو چنانچه شخصی با احتمالاتی که ذکر گردید مواجه شود می تواند با ذکر اوضاع و احوالي كه موجب درخواست تأمين دليل شده است از دادگاه در هنگام دادرسي و يا قبل از اقامه دعوا درخواست تأمين یا به به عبارتی ملاحظه و صورت برداري از دلايل را بنماید.
در حال حاضر رسیدگی به درخواست تامین دلیل از وطایف شورای حل اختلاف است که باید مطابق مقرراتی که در آیین دادرسی مدنی معین گردیده است، به درخواست رسیدگی نماید. ولیکن در خصوص درخواست تامین دلیل در حین رسیدگی در دادگاه اگر چه قانون در این خصوص مسکوت می باشد، علاوه بر اقدام برای اخذ تامین دلیل از طریق شورای حل اختلاف، با توجه به صلاحیت عام محاکم قضایی، دادگاه می تواند به درخواست تامین بخصوص در مواردی که مبنای صدور حکم است رسیدگی نماید، همانطور که گفته شد، تأمين دليل به منطور حفظ آن است و تشخيص درجه ارزش آن در موارد استفاده، با مرجع رسیدگی کننده به دعوا یعنی دادگاه یا شورای خل اختلاف مي باشد.
