دعوای متقابل
دعوای متقابل یا دعوای تقابل یکی از دعاوی طاری است که در اثنای رسیدگی به دعوای اصلی مطرح می شود و مواد (141) تا (143) آیین دادرسی مدنی به این موضوع اختصاص داده شده است. طبق ماده (141)خوانده مي تواند در مقابل ادعاي خواهان، اقامه دعوا نمايد. چنين دعوايي در صورتي كه با دعواي اصلي ناشي از يك منشاء بوده يا ارتباط كامل داشته باشد، دعواي متقابل ناميده شده و تواما رسيدگي مي شود و چنانچه دعواي متقابل نباشد، در دادگاه صالح به طور جداگانه رسيدگي خواهد شد. بين دو دعوا وقتي ارتباط كامل موجود است كه اتخاذ تصميم در هر يك مؤثر در ديگري باشد.
شرایط دادخواست دعوای تقابل : دعواي متقابل به موجب دادخواست اقامه مي شود و بايد تا پايان اولين جلسه دادرسي تقديم شود و اگر دعواي متقابل در جلسه دادرسي اقامه شود، طذف دعوا مي تواند براي تهيه پاسخ و ادله خود تأخير جلسه را درخواست نمايد. شرايط و موارد رد يا ابطال دادخواست همانند مقررات دادخواست اصلي خواهد بود.
