انکار و ترديد سند
سند یکی از دلایلی است که طرفین دعوا برای اثبات ادعای خود یا برای مردودشدن ادعای طرف مقابل استفاده می نمایند، علاوه بر دفاع ماهوی در مورد اصل دعوا، یعنی رد خواسته یا ادعایی که برای اثبات آن اسنادی ارائه شده است. به لحاظ شکلی نیز برابر ماده 216 قانون آیین دادرسی مدنی هرگاه در یک دعوا علیه شخصی سندی ارائه شود، چنانچه سند ارائه شده سند غيررسمي باشد، كسي كه عليه او سند ارائه شده است، مي تواند تعلق خط يا مهر يا امضا و يا اثر انگشتی را که در سند به او نسبت داده شده را نپذیرد یا اصطلاحا آن را انكار نمايد و هرگاه سند ابرازي کلا منتسب به شخص او نباشد مي تواند ترديد كند . سپس برای تشخیص اصالت سند کارشناس مربوطه انتخاب می شود تا با مقایسه مندرجات سند با اسناد و نوشتجاتی که متعلق به امضاء کنندگان سند می باشد، اصالت یا عدم اصالت مشخص شود.
در مقابل ترديد يا انكار، هرگاه ارائه كننده سند، سند خود را استرداد نمايد، دادگاه به اسناد و دلايل ديگر رجوع مي كند. استرداد سند دليل بر بطلان آن نخواهد بود، چنانچه صاحب سند، سند خود را استرداد نكرد و سند مؤثر در دعوا باشد، دادگاه مكلف است به اعتبار آن سند رسيدگي نمايد.
اظهار ترديد يا انكار نسبت به دلايل و اسناد ارائه شده حتي الامكان بايد تا اولين جلسه دادرسي به عمل آيد و چنانچه در جلسه دادرسي منكر شود و يا نسبت به صحت و سقم آن سكوت نمايد حسب مورد آثار انكار و سكوت بر او مترتب خواهد شد. در مواردي كه رأي دادگاه غیابی صادر مي شود، خوانده ضمن واخواهي از آن، انكار يا ترديد خود را به دادگاه اعلام مي دارد. نسبت به مداركي كه در مرحله واخواهي مورداستناد واقع مي شود نيز اظهار ترديد يا انكار بايد تا اولين جلسه دادرسي به عمل آيد.
